Ownership of the Service / Product: The products featured and displayed on the artstone.com website are the property of Artstone Panel Sistemleri A.Ş.. Their models, designs and/or other intellectual and industrial property rights are protected by relevant laws and may not be used or acquired without permission. The products, all technical information and documents on the site are protected by law.
The use of these materials in any social media, commercial advertising, or third-party publications is also exclusively owned by Artstone Panel Sistemleri A.Ş. and is protected by law. All rights to the information, logos, brands, designs, graphics, know-how, photographs, images, sounds and similar items relating to the products featured on the website and similar platforms mentioned above are reserved.
These contents may not be copied, reproduced, used or distributed in any way for commercial or personal purposes, even if the source is cited, without permission. Any action constituting a violation of the above provisions shall entail legal and criminal liability.
Limitation of Liability and Damages
Artstone provides no warranty, express or implied, of fitness for a particular purpose, average quality, or any other warranty, representation, or endorsement with respect to the Service it provides, but does not undertake that the products, services, or information purchased or ordered will meet the Buyer’s expectations.
Artstone cannot guarantee that the Service offered at artstone.com will be uninterrupted, timely, error-free, and cannot be held liable for any possible consequences arising from the use of the product on the site. The User obtains the most reliable professional and purchasing advice regarding the product from Artstone.
User Restrictions
Without Artstone’s prior written consent and without attribution, the User may not publish, copy, reproduce, distribute, transmit, upload to another electronic medium, email, communicate, or otherwise use any information or material on the Site, or the Site content, in whole or in part.
The User agrees not to upload or transmit any communication or service tool that infringes on the rights of artstone.com.
The User may not use the artstone.com site to sell another product or service, may not use it for commercial purposes to drive traffic to their own site, may not use a meta-search or conventional browser alternative automatic system within artstone.com, may not convert any software contained within the site into source code and copy it, and may not mirror any content on another server.
The user may not engage in any action on artstone.com that is disruptive to public order, violates public morality, disturbs or harasses others, is illegal, or infringes the intellectual and copyright rights of third parties. Users may not use any service or product on artstone.com in a manner that infringes upon the intellectual and industrial property rights of the owner.
Failure to comply with these rules will result in legal proceedings. All other rights of Artstone not specified or listed herein are reserved.
Authorisation
Any request, comment, feedback, note, message, idea, suggestion, criticism or other form of communication (hereinafter referred to as “Request”) sent by the user to artstone.com is the property of Artstone, provided that personal data remains confidential.
Infringement of Intellectual and Industrial Property Rights
Pursuant to the provisions of the Industrial Property Law No. 6769, the Copyright Law No. 5846, the Unfair Competition Provisions of the Turkish Commercial Code, and other applicable legislation, the following actions are subject to legal and criminal liability. Accordingly;
- Partially or fully reproducing the product to create a counterfeit,
- Selling or distributing such products knowing or having reason to know that they were produced by imitation, either in whole or in part,
- Introducing them into the commercial sphere in any other manner,
- Importing for these purposes,
- Possessing for commercial purposes,
- Using it by putting it into practice,
- Participating in, aiding, abetting, encouraging or facilitating the above acts,
- Refusing to disclose where and how the counterfeit product in one’s possession was obtained.
In the event of such infringements, the legal sanctions that may be imposed without limitation are as follows. Accordingly;
- A decision may be made to seize counterfeit products through precautionary measures,
- Compensation for material and moral damages may be sought,
- Their destruction may be requested,
- They may be publicly announced,
- Payment of lost profits may also be demanded,
- Imprisonment or a fine may be imposed by means of a public prosecution,
- The workplace may be closed and a ban on trading may be imposed.
The above are limited legal remedies, and Artstone reserves all rights to any additional claims and lawsuits.
Product Information
All products on artstone.com are displayed in electronic and physical environments and are sold by Artstone in relevant showrooms and dealer sales units. The products on the site are photographed to show their various independent and indoor uses. Colours are accurately defined. However, colour variations or differences in perception may occur depending on the screen; it cannot be guaranteed that the colours on the user’s screen will match the actual colours.
Delivery / Shipping
The User sends any requests regarding the product to Artstone. Artstone will respond to the User within 24 hours, either via its website or social media. Production times, delivery times, shipping, and application methods shall be subject to Artstone’s declaration.
Artstone is responsible for the delivery or application of the product in a sound and complete condition, in accordance with the specifications stated in the order, and with any warranty documents and user manuals, if applicable.
Warranty
Artstone is responsible for the warranty of the products listed on artstone.com.
Disputes
In the event of a dispute, the Istanbul Courts and Enforcement Offices shall have jurisdiction. The parties acknowledge and declare that all computer records belonging to Artstone shall be taken as the sole and exclusive evidence in accordance with Article 193 of the Code of Civil Procedure and that such records constitute an evidence agreement.
Indemnification
The User agrees to be liable for any damage, harm, obligation, loss, debt or expense that may arise from any misuse of the Artstone Terms of Service or any infringement of intellectual and industrial property rights. Furthermore, any legal and criminal liability that may arise from such misuse shall be borne by the User.
Consumer Awareness
All products bearing the Artstone brand and identity have a special Artstone logo-printed kraft paper backing, and all products have an “ID number” and a “special hologram” sticker on the back indicating that they are original. All panel-format products that do not have this feature are counterfeit products.
In this regard, and in order to raise consumer awareness, it is recommended that only videos and promotions made on the Artstone website and its own social media channels be trusted. In cases of design infringement, consumers should act responsibly and, in the event of unfair competition, inform Artstone to raise sectoral awareness, which will lead to a reduction in the number of suppliers of such low-quality products. This is crucial for raising the quality standards within the sector.
